Judge Jennifer Schecter of New York City: One of the Good Gals

 

The state of New York presented Jennifer Schecter with a law license in 1997 after she graduated from Seton Hall University Law School.

 

In one matter, Judge Schecter was assigned to preside over a case brought by Summer Zervos, a former Apprentice contestant who accused Donald “Trumporleone” Trump of defaming her during the 2016 presidential campaign after she said he sexually harassed her. (Rebecca Pilar Buckwalter Poza)

 

The Great Leader’s so-called Dream Team of lawyers filed a laughable motion to dismiss the Zervos defamation lawsuit. In their motion, the Aspiring Comedians argued the following:

  • Ms. Zervos’ allegations are false (that he sexually harassed her)
  • Her lawsuit is politically motivated
  • Alleged defamatory statements (she’s a liar) are not actionable
  • Calling her a liar was either “opinion” or “Hyperbole (BS)”
  • Lawsuit is barred by “Supremacy Clause”

In denying The Great Leader’s motion to dismiss the Zervos defamation case, Judge Schecter said in part:

  • Nobody is above the law
  • The is “absolutely no authority” to dismiss case based on “unofficial conduct” that took place before Trump was President
  • Calling Ms. Zervos a liar “bears no relationship to any federal executive responsibility”

Any first-year law student would know that the issue of falsity of The Great Leader’s statements calling Ms. Zervos a lair is an “issue of fact” that is left to a jury (the triers of fact) to determine. The same is true of The Great Leader’s argument that the she was “politically motivated” to sue him.

 

The U.S. Supreme Court decision in the Clinton v. Jones case clearly proves that a sitting president can be sued civilly for actions he took outside the office of the presidency which is exactly what took place when The Great Leader repeatedly called Ms. Zervos a liar.

 

As one would expect, The Great Leader’s trio of Dumbo Lawyers has vowed to appeal judge Schecter’s reasoned ruling. I’m betting that the Court of Appeals will tell them to take a hike.

 

After the New York state courts uphold Judge Schecter’s ruling, we can expect that The Great Leader’s lawyers will appeal to a Federal District Court, the Federal Circuit Court of Appeals and the U.S. Supreme Court. However, they will lose each and every time.

 

Kudos to Judge Schecter for displaying the courage and fortitude to do the right thing in denying The Great Leader’s laughable Motion to Dismiss.

 

As we speak (ca. December 2018), Judge Schecter continues to sit as a New York County Supreme Court Justice in New York, New York.
