Attorney Mark Davis of Victoria, TX; ethical gremlin

 

The state of Texas presented Mark Davis with a law license in 1999 after he graduated from South Texas University Law School.

 

First and foremost, it should be noted that this isn't Mark's first bite at the Attorney Misfits Apple Tree. He previously received one (1) complimentary reprimand and one (1) complimenatry probated suspension for engaging in a variety of misconduct.

In one matter, a former client alleges that Mark engaged in the following misconduct.

  • Failed to return numerous calls from client
  • Missed scheduled appointments at his office  
  • After paying Mark a $2500 upfront fee to handle an estate  matter, the client had not met with Mark for at least 18 months
  • Mark’s paralegal came up with a variety of specious claims regarding setting court dates, including the judge had a death in the family, the hearing was rescheduled when it wasn’t and the court clerk failed to put the hearing on the court docket
  • Client informed that Mark had paid for and placed in newspaper a notice to creditors to file their claims of any debts against the estate of the client’s deceased husband
  • Client repeatedly asked for a hard copy of the newspaper notice to creditors of the estate but one was never provided to her
  • Client called newspaper to obtain copy of creditor’s notice but was told they never heard of Mark or her husband
  • Mark failed to provide any receipt evidencing payment to the newspaper for creditor’s notice
  • Client advised by the probate court that the judge never had a death in the family that caused him to cancel a hearing
  • The client discharged Mark and demand a refund of her $2,500 retainer; however, over a year has passed and Mark has failed to even respond to said demand

In mid-2016, the client filed an ethics complaint with the State Bar and in doing so submitted documentary proof in support of the egregious manner in the way Mark treated her. Making matters worse is the fact that the client is a disabled senior citizen, a fact well known to Mark.

 

All that’s left now is to see what if any punishment is meted out to Mark by the apologists for Attorney Misfits sitting on the Texas Supreme Court.
