Attorney Joseph Conway of Mineola, NY; ethical gnome
The state of New York presented Joseph Robert Conway with a law license in 1988 after he graduated from the Brooklyn School of Law.
In one matter, United States District Court Judge Nicholas Garaufis of Brooklyn found Joey guilty of the following misconduct in his handling of a client matter.
The matter involved Joey’s representation of David Gotterup who was sentenced to 11 years in prison for conspiracy to commit mail, wire and bank fraud. Judge Garaufis said that Joey’s failure to file an appeal on behalf of Gotterup was "inexcusable as a matter of ethics and professionalism.”
Judge Garaufis went on to say that Joey “abandoned” Gotterup, leaving the job of filing a notice of appeal to his imprisoned client and the client’s brother who wasn’t an attorney. Unfortunately, Gotterup was led to believe that Joey would be filing the notice of appeal on his behalf.
Because Joey worked for the Eastern District’s U.S. Attorney’s Office for 15 years, and served as head of the office’s Long Island criminal division, Garaufis said filing the notice of appeal would have been a “perfunctory” task. On that point, Judge Garaufis went on to say.
“As such, he is quite obviously aware of trial counsel's obligation to protect the appellate rights of a criminal defendant by timely filing a notice of appeal.”
At the conclusion of his ruling, Judge Garaufis said he would be referring Joey’s conduct to the appropriate grievance committee as well as the Appellate Division, Second Department Presiding Justice Randall Eng.
All that remains now is to see what if any punishment is meted out to Joey by the enablers for Attorney Misfits sitting on the Greivance Committee of the Second Department Appellate Division.
