Attorney Edward Swinger of Nashville; repeat offender

 

The state of Tennessee presented Edward Swinger with a law license in 1990 after he graduated from the Nashville Law School.

 

The Board of Professional Responsibility found Eddy guilty of the following misconduct.

 

Eddy’s 1st bite at the Attorney Misfit Apple Tree

  • Collected excessive fee in violation of Victim Injury Compensation Statute
  • Failed to prepare legal matter entrusted to him
  • Failed to deliver to client’s entire amount due to them
  • Failed to properly notify clients of status of legal matter

As a direct consequence of his misconduct, the enablers for Attorney Misfits sitting on the Tennessee Supreme Court punished Eddy by gifting him with a complimentary censure.

 

Eddy’s 2nd bite at the Attorney Misfit Apple Tree

  • Pled guilty to serious crime and after completion of probation criminal record was expunged
  • Engaged in conduct adversely reflecting on fitness to practice law

As a direct consequence of his misconduct, the enablers for Attorney Misfits sitting on the Tennessee Supreme Court punished Eddy by gifting him with a complimentary 1-year suspension of his law license.

 

Eddy’s 3rd bite at the Attorney Misfit Apple Tree

  • Failed to keep clients informed of status of matter
  • Failed to act with due diligence (slacker)
  • Failed to hold client’s funds in a trust account
  • Failed to promptly payout settlement proceeds
  • Failed to provide competent representation (Dumbo)
  • Counseled a client to engage, or assisted a client, in conduct that he knew or reasonably have known is criminal or fraudulent
  • Engaged in a conflict of interest
  • Failed to expedite client litigation
  • Violate or attempted to violate the Rules of Professional Conduct, knowingly assisted or induced another to do so, or did so through the acts of another

As a direct consequence of his misconduct, the enablers for Attorney Misfits sitting on the Tennessee Supreme Court punished Eddy by gifting him with a complimentary 120-day suspension of his law license.

 

As we speak (ca. June 2017), Eddy practices in Nashville, Tennessee.
