In late 2005, the New York Judicial Commission found Judge Laura Blackburne guilty of the misconduct set forth below.
 
After pleading guilty to a drug conviction, defendants are allowed to enroll in a treatment program and upon successful completion, the guilty plea is withdrawn and criminal charge is dismissed. However, the defendant is required to appear at court hearings on a regular basis so that treatment can be monitored.
 
At such a hearing involving defendant Derek Sterling, the following took place:
 
Detective Leonard Delvin arrived at courthouse for the purpose of arresting Mr. Sterling on charges of robbery and assault
  1. The detective waited outside Laura’s courtroom in order to arrest Sterling after his case concluded
  2. Sergeant Peterson went to Laura’s chambers to tell her a detective was in the courtroom to question Mr. Sterling in connection with a robbery
  3. When court-appointed counsel, Silverman arrived at court he told the detective that Mr. Sterling declined to speak to him. The detective replied, “Then his going to the 106th [precinct].” Silver asked him if was going to arrest Sterling and the detective said ‘yes.”
  4. Silverman told Laura that the detective indicated that he was going to arrest Sterling
  5. Laura then said she was going to him Sterling taken out of the courtroom and out of the building through a side entrance [to obviously prevent his arrest]
  6. After the hearing concluded, Laura ordered Sergeant Peterson to take Sterling “out the back stairwell.” (This area is a secure hallway reserved for use by judges, jurors and court staff.)
  7. Sergeant Peterson said he was “stunned” by Laura’s orders but did not reply and feared he could get in trouble for either following or not following her order.
  8. Peterson asked the ADA [Assistant District Attorney]if he would consider it an obstruction of justice if he complied with Laura’s order
  9. The Sergeant then went to Laura again and told her he was “uneasy” about her order and asked her to speak to the ADA
  10. ADA Scott Brooking told Laura that taking Sterling out the back door was inappropriate
  11. Laura then ordered that Sterling be escorted out of the court through a private exit in order avoid arrest
The Judicial Commission’s ruling stated in part: “She placed herself above the law she is sworn to uphold and abused the power of her office, utilizing court personnel and court facilities to accomplish her goal of thwarting a lawful arrest.”
 
The Commission punished Laura by removing her from the bench.
 
Unfortunately, the enablers/apologists at the New York Bar took no action against Laura’s law license. This loser now practices law at 17964 Anderson Road in Jamaica, New York.
