Judge James Dunn of Los Angeles; incompetent boob 

The state of California presented James R. Dunn with a law license in 1963 after he graduated from Stanford University Law School.

In one matter, Jimmy presided over a medical malpractice case wherein a woman awoke while undergoing a medical procedure following a miscarriage sued the anesthesiologist and the hospital.

Jimmy the Dunce ruled that as a matter of law that the anesthesiologist who touched the woman while she as in the recover room and showed her a jar that contained what she thought was her dismembered fetus had not engaged in extreme and outrageous conduct.

The patient, Yun Hee So had undergone a dilation and curettage, commonly known as a “D&C,” following a miscarriage. Subsequently she sued the doctor, HP Anesthesia Medical Group and Hollywood Presbyterian Medical Center for administering inadequate anesthesia.

Subsequently, Judge Dunn ruled in favor of the doctor in dismissing Ms. So’s lawsuit. The Court of Appeals reversed Dunn’s ruling and said in part:

• As a matter of law, Dunn erred in ruling against So’s claims for assault and battery and infliction of emotional distress
• The jury could conclude that the doctor’s conduct was “extreme, outrageous, or outside the bounds of decency” so as to constitute intentional infliction of emotional distress
• The physician’s physical contact with Ms. So is a factual question for the finders of fact (jury) to decide [not Judge Dunn]

As a direct result of Judge Dunn’s incompetence, the taxpayer’s of California will be “dunned” (pun intended) by incurring the cost to have the matter re-litigated.

As we speak (ca. April 2016), Jimmy continues to sit as a Los Angeles Superior Court judge in Los Angeles, California.
