U.S. Judge Mark Kearney of Philadelphia; incompetent moron

The state of West Pennsylvania presented Mark A. Kearney with a law license in 1987 after he graduated from Villanova University Law School.

President Obama was duped into appointing Tommy U.S. District Court judge for the Eastern District of Pennsylvania in 2014. Mark didn’t receive the appointment because he was the most qualifed attorney in the Philadelphia area. He received it because he had proven to be a reliable lackey for the local political hacks.

Mark was assigned to hear a case that involved recording police officers while their performing their taxpayer funded duties.

In a totally asinine ruling that appears to have been based on Mark’s ongoing effort to establish himself as one of America’s Premier Judicial Morons (my sincerest apologies to Morons), he ruled that the public does not have a right to record police officers. Towards that end, the Moron said in his ruling:

Recording police officers is not protected by the 1st Amendment unless the recorders [citizens] are making an effort to “challenge or criticize” the police.

This ruling makes absolutely no sense and flies in the face of rulings issued by several federal circuit courts that recording police activity is constitutionally protected regardless of whether the one doing the recording is attempting to make a statement or issue a challenge to the conduct of law enforcement.

The American Civil Liberties Union (ACLU) stated that it planned to appeal the absurd ruling by Mark the Moron to the Circuit Court of Appeals.

Apparently, Mark would have a private citizen first ask a police officer who was wrongfully beating the shit out of someone for his/her permission to record the event. I’m sure most if not all offending police officers would immediately respond by saying, “Yeah, go ahead, this is America!”

As we speak (ca. March 2016), Mark continues to sit as a U.S. District Court judge in Philadelphia.

And lastly, given the fact that Mark’s only 49-years-old, the good folks in Philly can expect to be the recipients of more of is laughable rulings for the next 30 or more years.
