Attorney Michael Atwater of Columbia, SC; serial offender, Dumbo

 

The State of South Carolina presented Michael E. Atwater with a law license in 1994 after he graduated from the University of South Carolina Law School.

 

Disciplinary Counsel of the South Carolina Supreme Court found Mike guilty of the following misconduct.

 

Mike’s 1st bite at the Attorney Misfit Apple Tree

  • Failed to provide competent representation (Dumbo)
  • Failed to act with due diligence (slacker)
  • Failed to explain matter to extent necessary to permit client to make informed decisions regarding representation
  • Failed to keep client informed of status of legal matter
  • Failed to comply with client requests for information
  • Failed to provide client with written fee agreement
  • Acted as advocate at a trial in which he was likely to be a necessary witness
  • Made a false statement of material fact and/or failed to disclose a fact necessary to correct a misapprehension known by him to have arisen in disciplinary matter
  • Engaged in conduct involving fraud, deceit, dishonesty or misrepresentation
  • Engaged in conduct prejudicial to the administration of justice

As a consequence of his misconduct, the Cheerleaders for Attorney Misfits sitting on the South Carolina Supreme punished Mike by gifting him with a complimentary reprimand.

 

Mike’s 2nd bite at the Attorney Misfit Apple Tree

  • Failed to cooperate with ethics investigators (Up yours, said Mike!)
    Engaged in a pattern of misconduct
  • Failed to acknowledge wrongdoing

As a consequence of his misconduct, the Cheerleaders for Attorney Misfits sitting on the South Carolina Supreme punished Mike by gifting him with a complimentary 6-month suspension of his law license.

 

Mike’s 3rd bite at the Attorney Misfit Apple Tree

  • Engaged in conduct prejudicial to the administration of justice
  • Failed to adequately communicate with client
  • Failed to accept responsibility for misconduct

As a consequence of his misconduct, the Cheerleaders for Attorney Misfits sitting on the South Carolina Supreme punished Mike by gifting him with a complimentary 6-month suspension of his law license.

 

As we speak (ca. June 2015), Mike practices at 4740 Cedar Springs Road in Columbia, South Carolina.
