US Judge Lynn Winmill of Idaho; moron
The state of Idaho presented Lynn B. Winmill with a law license in 1977 after he graduated from Harvard University Law School.
Former President Bill Clinton was duped into appointing Winmill as a District Court Judge in 1995 even though he wasn’t the most qualified attorney in Idaho. Winmill received his appointment because he had proven to be a reliable lackey for the local political hacks.
In one matter, Judge Winmill was assigned to hear a case involving the Shoshone-Bannock Tribe and David Evans.
Winmill ignorantly ruled that that the Tribes had the authority to regulate the land use of David Evans, a nonmember of the Tribes, who owns land in fee simple within the Fort Hall Reservations.
In siding with the Tribes, Winmill ignored the rule that tribes cannot regulate nonmember conduct on non-Indian fee land by ruling that the tribes had a plausible basis for asserting said jurisdiction.
In failing to appreciate and/or comprehend the law, Winmill improperly rejected Mr. Evans’ attempt to enjoin trial court proceedings by ruling that Evans had to first exhaust tribal remedies even though the tribe had no jurisdiction over Mr. Evans.
In reversing Winmill’s specious decision, the Court of Appeals noted that his denial of Evans’ motion for a preliminary injunction and dismissal of an action to enjoin tribal proceedings against him, the three-judge appellate panel stated that the Shoshone-Bannock Tribes lacked any power to regulate the land use of a non-member who owned land in fee simple.
The appellate court concluded by saying that, contrary to the Winmill’s conclusion, the Tribes plainly lacked the power to regulate Evan’s conduct. The case was then sent back to Lynn the Moron to see if he could get it right on the second go round.
Unfortunately, the taxpayers are forced to pay for this type of gross incompetence. In fact, Winmill can never be sanctioned or disciplined no matter how many times he issues asinine rulings.
