THEFT-IN-OFFICE INVOLVING OHIO SUPREME COURT JUSTICES

The following summary is intended to set forth irrefutable facts of abuse of state property and/or employees by Chief Justice Moyer, Justice Maureen O'Connor and Justice Francis Sweeney.

No. 1 - Moyer's "Illegal" Christmas Gift for Justice Francis Sweeney

Sweeney's tern of office ended on Dec. 31, 2004 and he was replaced by Lanzinger who took office on Jan 1, 2005. 

On January 7, 2005, seven (7) days after his term expired and he was no longer an employee of the Supreme Court or the State of Ohio, Sweeney purchased 14.7 gallons of fuel at Schmidt's Marathon in Lakewood at 8:20 a.m.   The receipt bears Sweeney's signature. This means that Moyer "unlawfully" allowed Sweeney to retain a state car, state fuel charge card and purchase fuel "after" he was no longer an employee of the Court or State.

As to the exact date that Sweeney returned the state's $41,000 fully-loaded Buick Park Avenue, I do not know.  In fact, I don't know if Sweeney still has possession of the car.  However, if it has been returned, then either Sweeney drove it back to Columbus or Moyer sent a couple of court flunkies to Cleveland at taxpayer expense to pick it up, which is what he did in picking up Resnick's Jeep in Findlay in Feb. 2005. 

I haven't had time to research this matter, however, it appears that this may well constitute a theft offense.  Moreover, it would appear that Moyer may be guilty of aiding and abetting said theft.  Regardless, this is typical of the thefts and tax fraud engaged in by Moyer, et al. over the past ten or more years.


No. 2 - Questionable Fuel Consumption - Justice O'Connor

O'Connor's 2001 Jeep Grand Cherokee Laredo is rated at 16/21 city/highway.  In 2004 she purchased 961.1 gallons of fuel (no records provided for Aug/Sept- used 2003 purchases), meaning she drove 17,780. During this time, she would have made 13 roundtrips (254 miles) to Columbus for oral argument sessions; commuted 3,302 miles and used 178.5 gallons of fuel.

O'Connor claims 45.1% for official use which means she drove 6,491 miles and used 350.9 gallons of fuel, which is clearly false. Examples of how specious O'Connor's claims are as follows:

  1. Jan-Feb '04  bought 186.7 gallons and drove 3,454 miles to attend 1 court session (274 commuting miles). 

  2. April-May  '04 bought 241.5 gallons and drove 4,468 miles for 4 trips (1,096 commuting miles) to attend oral arguments.

  3. Nov-Dec '04 bought 96.6 gallons and drove 1,787 miles even though no court sessions were held.

  4. April '03 bought 136.5 gallons and drove 2,525 - only 1 court session

  5. May 2003 bought 121.1 gallons and drove 2,240 miles - only 1 court session

No. 4 - Did Someone Other than Justice O'Connor use her State fuel card/car on Oct. 26, 2004?

The following facts would indicate that someone other than O'Connor may have used her state fuel charge card on Oct. 26, 2004.

  1. Oral arguments at the Court in Columbus began at 9:00 am on the 26th and end at 11:30, meaning she would have had to leave Akron no later than 6:30 a.m. to attend the 9:00 am session.

  2. Her charge card was used in Strongsville at 6:30 am on the 26th. [Strongsville is 40 miles north of Akron; Columbus is South]

  3. Her card was then used at 10:54 in Clyde, which is 71 miles and 72 minutes  "due east" from Strongsville. 

  4. It's 109 miles from Clyde to Columbus and takes 2 hrs and 15 minutes, meaning she couldn't have arrived in Columbus until 1:15 pm.

  5. The most important question is why would O'Connor drive North to Strongsville and then East to Clyde on her way to Columbus? 

  6. O'Connor's charge receipts for the 26th show that they came directly from the pump, so there's no signatures. 

  7. The only way this didn't happen is if O'Connor was not present for oral arguments on the 26th.  If she was, then she broke the law!

No. 5.    Moyer's Illegal Use of State Employees

The following facts, all of which were gleaned from a review of court records, proves that on several occasions that Chief Justice Moyer illegally used state employees to deliver his personal vehicle to the Columbus Airport.

Jan, 24-29, 1998 - Marriott's Grand Hotel Resort and Golf Club - Point Clear, Alabama

  1. Moyer and his wife Mary depart Columbus at 12:50 pm and arrive in Point Clear, Alabama at 3:54 pm on the 24th

  2. Moyer's parking receipt ($6.87) shows that at 11:39 am on Jan 29, Tom Brandt parked (delivered) Moyer's car at the Thrifty Car Rental parking lot on Steizer Road

  3. Moyer and Mary departed Point Clear at 2:10 pm and arrived in Columbus at 7:18 pm on Jan 29

  4. Moyer's parking receipt shows that he and Mary picked up his car at Thrifty's lot at 7:41 pm (23 minutes after he arrived)

Jan. 30 to Feb, 3, 2000 - Four Seasons Hotel in Austin, Texas

  1. Moyer and his wife Mary depart Columbus at 5:45 pm and arrives in Austin, TX at 9:34 pm on the 30th

  2. Moyer's parking receipt shows his car was parked at the airport at 4:43 pm on the 30th

  3. The same parking receipt shows that Moyer's car left the airport at 12:51 pm on the 31st (he was already in Austin)

  4. Therefore, it appears that Tom Brandt, along with another state employee traveled to the airport on the 31st and retrieved Moyer's car while both employees were being paid with state funds

July 29 to Aug 2, 2001 - Seattle, Washington

  • Moyer and his wife left Columbus on the 29th, however, there are no parking receipts for this trip.  Therefore, it is highly likely that Moyer and Mary were transported to the Columbus airport by state employees in a state car.  It is illegal for Mary to travel in a state car. 

Jan 19-23, 2001 - Hyatt Regency on the Inner Harbor in Baltimore, Maryland 

  • Moyer and his wife left Columbus on the 19th, however, there are no parking receipts for this trip.  Therefore, it is highly likely that Moyer and Mary were transported to the Columbus airport by state employees in a state car.  It is illegal for Mary to travel in a state car. 

  • It should be noted that it appears that Moyer "illegally" billed and collected $40.68 for the cost of a lunch at the City Lights Restaurant in Baltimore for him and Mary.  The meal receipt shows 6 guests for a total of $123.93, meaning that the average meal was $20.65.

July 28 to Aug 2, 2003 - the Samoset Resort on the ocean in Camden-Rockport, Maine ($266 a night)

  • Moyer and his wife left Columbus on the 28th, however, there are no parking receipts for this trip.  Therefore, it is highly likely that Moyer and Mary were transported to the Columbus airport by state employees in a state car.  It is illegal for Mary to travel in a state car. 

Jan 26-30, 2003 - Kingsmill Resort in Williamsburg, Virginia

  • Moyer and Mary left Columbus on the 26th, however, the Court failed to provide me with travel expense records as I requested.  It is highly likely that Moyer and Mary were transported to the Columbus airport by state employees in a state car.  It is illegal for Mary to travel in a state car. 

July 27-31, 2003 - The Ritz-Carlton in San Juan, Puerto Rico

  • Moyer and Mary left Columbus on the 27th, however, the Court failed to provide me with travel expense records as I requested.  It is highly likely that Moyer and Mary were transported to the Columbus airport by state employees in a state car.  It is illegal for Mary to travel in a state car. 

Jan 18-21, 2004 - The Westin St. Francis Hotel in San Francisco, California

  • Moyer and his wife left Columbus on the 18th, however, there are no parking receipts for this trip.  Therefore, it is highly likely that Moyer and Mary were transported to the Columbus airport by state employees in a state car.  It is illegal for Mary to travel in a state car.
