The New Mexico Judicial Standards Commission Found Dave guilty of the following misconduct.

In one matter, Dave found it acceptable to vouch for the character of a criminal defendant in a case that was pending in a different court.

Dave admitted that he contacted Grant County Magistrate Judge Maurine Laney in an effort to personally vouch for the character of a criminal defendant in her court, and to obtain special treatment for the criminal.

As a consequence of his misconduct, the New Mexico Supreme Court punished Dave by gifting him with a complimentary censure.

As we speak (ca. November 2014), Dave continues to sit as a Hurley Municipal Court judge in Hurley, New Mexico.
