Judge Bruce Pickett of Idaho Falls; incompetent boob

 

The state of Idaho presented Bruce Pickett with a law license in 1997 after he graduated from Brigham Young University (BYU) School of Law.

 

In one matter, Bruce ruled on a case concerning the disposition of the estate of Birch and Bailey’s mother, Ruth Birch that was preliminarily handled by a court magistrate.

 

The magistrate overseeing the case, approved a compromise agreement that allowed Birch and another intentionally omitted sibling to receive equal shares of their mother’s estate. After approval of the compromise agreement, Bailey requested that Birch pay the estate’s attorney fees for preparing the agreement. Birch objected and filed a motion to remove Bailey as the personal representative of the estate.

 

Shortly thereafter, the magistrate awarded attorney fees in the amount of $10,314.50 which was assessed against Birch’s interest in the estate. Several months later, the magistrate entered a supplemental order wherein it was acknowledged that the court didn’t have the equitable power to asses fees, and instead cited Idaho Code section 15-3-720 as the basis for the award of fees.

 

Birch then appealed the magistrate’s fee award to Judge Pickett who upheld the award and ruled that Birch waived any challenge to the second of attorney fees by failing to object to Bailey’s memorandum of costs and fees within fourteen days as required by Idaho Rule of Civil Procedure 54(d)(5). Birch filed an appeal with the Court of Appeals, which reversed Pickett’s asinine ruling. In its reversal, the appellate court stated in part:

  • Failed to comply with requirements of the Idaho Rules of Civil Procedure
  • Engaged in an abuse of discretion
  • Erroneously affirmed magistrate court’s second award of attorney fees
  • The court never entered an order awarding said fees giving Burch no meaningful opportunity to object

The Court of Appeal then sent the case back to Judge Pickett.

 

Obviously, Judge Picket doesn’t’ much give a damn how many times his decisions are reversed since he well knows that no judge in Idaho has ever been removed from the bench for being a moron. And moreover, he isn’t concerned with the costs incurred by Idaho taxpayers to correct his ignorant behavior.

 

As we speak (ca. April 2019), Bruce continues to sit as a Seventh Judicial District Court Judge in Idaho Falls, Idaho.
