Former Judge Bernard Mogil of Great Neck, NY; serial liar, bully
While sitting as a judge on the Nassau County Court, the Judicial Commission found Bernard guilty of the following misconduct, much of which involved Bernard’s dislike of attorney Thomas Liotti who was president of the Criminal Courts Bar Assn (CCBA) of Nassau County.
During the time Liotti was president of CCBA; Bernie openly criticized him and suspended his participation in the organization. Later one, Liotti sent a letter to Bernie’s superiors, Justices Leo F. McGinity and Marie G. Santagata, wherein he sharply criticized Bernie’s conduct and his mental and professional fitness to serve as a judge. He also was critical of Bernie’s vanity plate that read “GUILTY.”
In retaliation, Bernie wrote a letter to Liotti signed by the “Wyatt Earp Assn,” which referred to Liotti as a “Donkey-turd, a “traffic court jerk, and asked if Liotti’s family or Newsday would like to learn about his “Bimbos and Feds and threats” in Denver, and warned Liotti that “People in glass houses should be VERY careful. In follow-up letters to Mr. Liotti, Bernie made the following statements:

Knowing that his despicable conduct would likely result in ethics complaints being lodged against him by attorneys who unfortunately had to deal with him, Bernie warned complaining attorneys as follows:
Bernie’s false testimony re: Email to Pres. Clinton
Bernie sent then Pres. Clinton an email on his personal AOL account that criticized the President’s policies regarding Haiti. The body of the email specifically stated that the sender was “Judge B. Marc Mogil of Great Neck. Subsequently, Bernie received a reply from the Whitehouse with President Clinton’s signature.
When asked by commission investigators about the Clinton email, Bernie falsely denied under oath (perjury) that he sent the email. The Commission also ruled that Bernie gave false testimony (perjury) during a hearing on several other occasions.
As a consequence of his despicable conduct, the Commission on Judicial Conduct ordered that Bernie be removed from the bench.
Because Judicial Misfits in New York are held to a much lower standard of conduct then everyone else, Bernie was never criminally charged with perjury or obstruction of justice.
As we speak (ca. May 2012) Bernie isn’t able to practice law in New York because his license has been suspended. Bernie’s license in Florida is also suspended, however, in the recent past he applied for reinstatement which was denied.
There is a distinct possibility that the enablers for Judicial Misfits sitting on the Florida State Bar will eventually reinstate Bernie’s law license.
