Sacramento Judge Peter McBrien deserved to be tossed from the bench?

 

 
Judge Peter (“Chainsaw Pete”) McBrien of Sacramento County Superior Court has dedicated he career to the total avoidance of propriety. Additionally, Chainsaw Pete is a certified moron (my apologies to morons). In 1999, Chainsaw Pete was criminally charged with savaging several aged oak trees that blocked his view of the American River.
 
Subsequently, Chainsaw Pete pleaded guilty and shortly thereafter the enablers/apologists (aka, wimps) sitting on the California Judicial Commission punished Chainsaw Pete by gifting him with a “complimentary reprimand.”  An article authored by R.V. During his reign of terror on the family court in Sacramento, and as could be expected, Chainsaw Pete engaged in even more egregious misconduct by intentionally visiting untold harm upon Mr. Ulf Carlsson, who had a divorce action pending before the Saw. Comparison of Chainsaw Pete’s punishment v. that of other Judicial Misfits
 
After being adjudged guilty of a plethora of egregious misconduct by the California Judicial Commission, Chainsaw Pete was gifted with a complimentary “severe censure.” Without doubt, Chainsaw Pete should have been removed from the bench; however, because judges are held to a lower standard of conduct then we are, he wasn’t.
 
Now let’s review some cases wherein judges were actually removed from the bench rather than being the recipient of a “complimentary severe censure.” Following the judges names are articles (when available) that provide more detail along with the relevant URL.
 
Judge Nicholas Del Vecchio of Las Vegas removed for having a sexual relationship with his step-daughter who was 14 at the time. Isn’t like it was his real daughter, right?

Judge Allan Clifford Berkhimer of Cambria County, PA removed in 2005 for DUI offense and for routinely using improper and offensive language when dealing with court staff and others.
 
Judge Richard Ryan of Roseville, CA for telling dirty jokes to female attorneys and for habitually hosing the taxpayers by not showing up for court.
 
Judge Kevin Ross of Los Angeles removed in 2005 for working hosting a “Miss Wet on the Net” contest and working on a format for a TV show akin to “Judge Judy” on court time.
 
Obviously, the Judicial Misfits named above deserved to be removed from the bench. However, when a judge intentionally violates a litigant’s “due process” rights and takes affirmative action to punish such a person (Ulf Carlsson), then in my opinion Chainsaw Pete should have been removed from the bench forthwith by the enablers sitting on the California Judicial Commission for the protection of the residents of Sacramento County.
 
Conclusion
 
My advice to Ulf Carlsson given the magnitude of the intentional damages that Chainsaw Pete cheerfully visited upon him (loss of his job, liftetime pension and health benefits and well over $100,000 in attorney fees) would be to file a lawsuit to collect for said damages.
