The Law Society presented David Rae with a law license in 2002.

 

The Solicitors Disciplinary Tribunal found Davey guilty of the following misconduct.

  • Caused or permitted the firm to become engaged in a pattern of excessive and reckless borrowing
  • Received and retained monies the firm had received from the Axiom Fund when it was improper for him to do so
  • Engaged in conduct involving fraud, deceit, dishonesty, or misrepresentation
  • Improperly became owner of firm even though he was not a solicitor and not otherwise regulated by the Solicitors Regulation Authority, contrary to principles governing said conduct
  • Permitted his firm to become engaged in a pattern of excessive and reckless borrowing
  • Exerted an inappropriate level of control over the management and running of the firm and its finances to the exclusion of the solicitors who were supposed to be running it
  • Caused or permitted the firm to use monies borrowed from the Axiom Fund not in accordance with the strict terms of the firm’s litigation funding agreement

As a direct consequence of his misconduct, the enablers for Solicitor Misfits sitting on the Disciplinary Tribunal punished Davey by gifting him with a complimentary fine of £200,000 (US $244,437.09) and ordered to pay costs of £17,675 (US $21,603.44).

 

As we speak (ca. May 2020), Davey practices with Cornwall Council at New County Hall, Legal Services, Truro in Cornwall, England.
