Solicitor David Sutherland of Scotland; ethical troll

 

The Law Society presented David Eric Sutherland with a law license in 1982 after he graduated from the University of Glasgow School of Law.

 

The Scottish Solicitors’ Discipline Tribunal found Dave guilty of the following misconduct.

  • Engaged in unsatisfactory professional conduct
  • Entered into an agreement to reduce the principal sum sued for to a figure without the ordinary court and legal aid levels
  • Agreed that his client would be liable for the expenses of a discharged diet of debate  
  • Amended the without advising his client that he was doing so and the consequences of the reduction and his doing so without his client’s instructions
  • Failed to inform client he had amended the principal sum sued for
  • Failed to advise client that had agreed that his client would be liable for expenses of a discharged diet of debate,
  • Failed to inform client that a motion had been lodged seeking expenses against the client
  • Failed to inform client that awards were made against the client for expenses in favor of his opponents
  • Entered into an agreement without the client’s instructions

As a direct consequence of his misconduct, the enablers for Solicitor Misfits sitting on the Discipline Tribunal punished Dave by gifting him with a complimentary censure and a fine in the sum of £1,000.

 

As we speak (ca. June 2018), Dave practices at 10-16 Exchequer Row in Aberdeen, Scotland.
