Attorney Lynne Layber of Brookfield, WI; drunken scofflaw

 

The state of Wisconsin provided Lynne A. Layber with a law license in 1992 after she graduated from the University of Wisconsin-Madison Law School.

 

In one matter, at about eleven o’clock p.m., Lynne was stopped by a Milwaukee County Sheriff on westbound I-94 in Milwaukee after she spotted Lynne deviating between two lanes. Subsequently, the officer pulled over Lynn and approached her car and asked her to produce her driver’s license.

 

At that time, the officer detected a strong odor of alcohol on Lynne’s breath, that her speech was slurred and it took her some time to find her license. After administering three field sobriety tests. She was then arrested at the scene for driving under the influence (DUI) and taken to the nearest Sheriff’s substation.

 

At the substation, Lynne repeatedly refused to submit to a breath test to measure her alcohol consumption. Under Wisconsin law, after someone refuses such a test, “the law enforcement officer shall immediately take possession of the person’s license and prepare a notice of intent to revoke.”  This was done and Lynne later exercised her right to request a hearing to determine whether her refusal was proper.

 

At a subsequent hearing, the trial judge ruled that Lynn’s argument that she wasn’t properly advised of her rights concerning the taking of the breath test was improper. Put simply, the trial judge ruled that Lynn’s argument was pure bunk (BS).

 

After losing at the trial court level, Lynn had the chutzpah to appeal that decision to the Court of Appeals, which basically spanked her by upholding the trial court’s ruling that she violated Wisconsin law when she refused to take a breath test.
