The state of West Virginia presented David S. Hart with a law license in 1999.

The Lawyer Disciplinary Board found Dave guilty of the following misconduct.

• Failed to return numerous client phone calls
• Failed to cooperate with ethics investigators (Up yours, said Dave!)
• Failed to act with due diligence (slacker)
• Failed to communicate with client
• Failed to file timely appeal on client’s behalf despite being paid $7,000
• Failed to provide competent representation (Moron)
• Lied to client that he had in fact filed appeal with Supreme Court
• Failed to respond to client requests for information
• Engaged in conduct prejudicial to the administration of justice
• Engaged in a pattern of misconduct
• Failed to make reasonable efforts to accomplish client objectives
• Failed to expedite client litigation
• Failed to safeguard client property
• Failed to exhibit any remorse for his egregious misconduct
• Failed to provide client with accounting of legal services performed
• Failed to refund unearned fees (crook) re: at least three clients
• Misconduct involved multiple offenses
• Exhibited indifference to making restitution victimized clients

As a consequence of his misconduct, the apologists for Attorney Misfits sitting on the West Virginia Supreme Court punished Dave by gifting him with a complimentary 3-year suspension of his law license.

As we speak (cal June 2015), Dave practices with Hayden & Hart PLLC at 102 McCreery Street in Beckley, West Virginia.
