Attorney Merwin Spencer of Everett, WA; thieving slacker

The State of Washington presented Merwin Moe Spencer with a law license in 2008 after he graduated from Seattle University School of Law.

The Washington State Bar found Merwin guilty of engaging in the following misconduct.

  • Failed to act with due diligence (slacker)
  • Failed to communicate with his client
  • Charged and/or collected an unreasonable fee (crook)
  • Failed to decline/terminate representation when required to so act
  • Failed to expedite client litigation
  • Failed to act fairly in dealings with opposing party and counsel
  • Engaged in the illegal practice of law in jurisdiction where he wasn’t licensed
  • Improperly employed disbarred attorney
  • Engaged in conduct prejudicial to the administration of justice
  • Engaged in conduct involving fraud, deceit, dishonesty, or misrepresentation
  • Failed to deposit client’s advance fees into respondent’s trust account
  • Failed to refund unearned fees
  • Failed to surrender client filed upon being terminated
  • Failed to cooperate with ethics investigators (Screw you, said Merwin!)
  • Failed to respond to opposing counsel’s motions
  • Failed to appear for properly scheduled court dates
  • Failed to keep client informed of status of matter
  • Made one or more misrepresentations [lied] to his client

As a direct consequence of his misconduct, the enablers for Attorney Misfits sitting on the Washington Supreme Court punished Merwin by gifting him with a complimentary 3-year suspension of his law license.
