In one matter, Cynthia McClease hired David to prepare and file multiple Qualified Domestic Relation Orders (QDROs) for the purpose of effectuating the division of her ex-husband’s retirement plans as set forth in a property settlement agreement that was part of the final divorce decree.

In order to have the QDROs entered into the record; David had to have the divorce case reinstated on the court’s docket. It took David nearly one year before he had the case reinstated on the court’s docket. Subsequently, the trial court reinstated the case; however, the case was later struck from the court’s because no order or decree had been submitted by David for more than six months after the case was reinstated.

Dave did not inform Ms. McClease that her case had been removed from the court’s docket. After she learned of the dismissal from the Norfolk Circuit Court Clerk’s Office, Ms. McClease immediately fired Dave the Dufus and demanded return of her file and a refund of the advanced fees she had paid.

David did not refund the unearned fees until eight days after he received a copy of Ms. McClease’s ethics complaint from the State Bar.
As a consequence of his misconduct, the enablers for Attorney Misfits sitting on the Virginia State Bar Disciplinary Board punished David by gifting him with a complimentary 150-day suspension of his law license. .
