Attorney H. Kenneth Merritt Jr. of Burlington, VT; ethical troll   

 

The state of Vermont provided H. Kenneth Merritt Jr. with a law license in 1988 after he graduated from the University of Michigan School of Law. 

 

The Vermont Bar Court found Kenny guilty of the following misconduct.

  • Made false statements under oath on the 5500-SFERISA forms [perjury]
  • Misconduct involved multiple offenses
  • Violated ERISA Act by engaging in prohibited transactions
  • Engaged in a pattern of misconduct
  • Made multiple false statements in connection with annual filings of the 5500-SF forms over a six-year period
  • Engaged in conduct involving fraud, deceit, dishonesty or misrepresentation
  • Misconduct adversely reflects on fitness to practice law
  • Conduct caused significant actual injury to the public
  • Violated ERISA by making prohibited loans totaling $1.5 Million over six-year period

As a direct consequence of his misconduct, the cheerleaders for Attorney Misfits sitting on the Vermont Supreme Court punished Kenny by gifting him with a complimentary reprimand.

 

As one would suspect, Kenny fails to mention the misconduct set forth above on his self-serving website at www.merritt-merritt.com. Apparently, Kenny decided to conceal this relevant information from prospective clients so that he would not limit his future victim pool.

 

And lastly, because Attorney Misfits in Vermont are held to a much lower standard of conduct then everyone else, Kenny was never criminally prosecuted for perjury.
