Attorney David Turcotte of Park City, UT; ethical gremlin

 

The state of Utah presented David G. Turcotte with a law license in 1993 after he graduated from Brigham Young University (BYU) Law School.

 

The Ethics and Discipline Committee of the Utah Supreme Court found Dave guilty of the following misconduct.

 

In one matter, a company that Dave represented entered into a third party security agreement with a bank. The agreement assigned a security interest to the bank and rights
to proceeds received by the company in a lawsuit wherein the company was a plaintiff. Dave represented the company throughout the lawsuit.

 

Dave was keenly aware of the existence, terms and conditions of the agreement. Even so, he obtained a judgment in the lawsuit in favor of the company and received funds on behalf of the company.

 

Unbelievably, Dave determined that the bank was not owed any monies from the settlement proceeds and disbursed the proceeds to third parties other than the bank. In on case, Dave disbursed funds that directly benefited entities that Dave owned or that he controlled.

 

Dave found it acceptable to disburse the settlement funds without every notifying the bank of his receipt of said funds.

 

As a consequence of his misconduct, the enablers for Attorney Misfits sitting on the Utah Supreme Court punished Dave by gifting him with a complimentary reprimand.

 

As we speak (ca. September 2014) Dave practices with GWN Corporate Services in Park City, Utah.
