The state of Utah presented David O. Drake with a law license in 1977.

 

The Chair of the Ethics and Discipline Committee of the Utah Supreme Court found Brent guilty of the following misconduct.
  • Failed to properly supervise his employee
  • Failed to ensure employee’s conduct was compatible with Dave’s profession obligations as an attorney 
In one matter, David was hired to represent an employee in a civil lawsuit. David allowed his non-attorney employee to take a sworn statement of the defendant the client was suing.
 
In a second matter, David was hired to represent a client in a personal injury matter. David permitted his
non-attorney employee to enter into and sign a contingent fee retainer agreement and prepare and submit a settlement demand letter to an insurance company on behalf of the client, which resulted in a recover for the client.
 
In a third matter, David was hired by a client who was involved in an automobile accident. David permitted
his non-attorney employee to sign a lien to a medical provider, which required David’s signature. When the
client’ case settled, David’s non-attorney employee deposited the settlement funds into an attorney trust
account, which the employee had inappropriately opened.
 
David failed to properly supervise his non-attorney employee, and failed to ensure that his employee’s conduct
was compatible with David’s professional obligations as a lawyer.
 
As a consequence of his misconduct, the enablers for Attorney Misfits sitting on the Utah Supreme Court
punished David by gifting him with a complimentary reprimand.
 
As we speak (December 2012) David practices with The Law Office of David Drake PC at 6905 South
1300 East in Midvale, Utah.
