Attorney Benjamin Small of Concord, NC; ethical leprechaun

 

The state of North Carolina provided Benjamin S. Small with a law license in 1984.

 

The Grievance Committee of the North Carolina State Bar found Benny guilty of the following misconduct.

  • Failed to comply with court rules re: request to reschedule trial date
  • Filed sham motion to have DA removed from client’s case
  • Caused significant harm to his clients (victims)
  • Court ruled motion to remove DA constituted vexatious litigation
  • Billed $100 an hour more than agreed to at outset of representation
  • Filed frivolous lawsuit against heirs of an estate
  • Misconduct involved multiple offenses
  • Engaged in conduct prejudicial to the administration of justice
  • Improperly engaged in ex parte (one-sided) communications with judge
  • Knowingly disobeyed the rules of a tribunal
  • Failed to cooperate with ethics investigators (Up yours, said Benny!)
  • Conduct led to limited court resources to be wasted
  • Repeatedly sanction by court for engaging in frivolous conduct
  • Victims of misconduct were vulnerable
  • Engaged in a pattern of misconduct
  • Refused to acknowledge wrongful nature of misconduct

As a consequence of his misconduct the cheerleaders for Attorney Misfits sitting on the Grievance Committee of the North Carolina State Bar punished Benny by gifting him with a complimentary 2-year suspension of his law license.

 

As we speak (ca. February 2016) Benny practices at 6208 Cress Road in Concord, North Carolina.
