Attorney Herbert Ray of Binghamton, NY; ethical leprechaun

The state of New York presented Herbert Barth Ray with a law license in 1961 after she graduated from Cornell University Law School.

Herbie’s misconduct took place while he was employed as a Broome County Family Court judge in Binghamton, New York. The New Commission on Judicial Conduct found Herbie guilty of the following misconduct.

• Engaged in favoritism in appointing law guardians
• Gave 1 attorney 18 percent of law-guardian appointments in his court
• Gave another attorney 6.4 percent of law-guardian appointments in his court
• Knowingly violated court rules in repeated appointment of law guardians
• Improperly made law-guardian appointments from bench, which was clerk’s responsibility
• Approved payment of attorney fees by County for work attorneys never performed
• Approved attorney fee claims for hours worked in court even though the court was not open on any given day for the amount of hours claimed

As a consequence of his egregious misconduct, the enablers for Judicial Misfits sitting on the Commission on Judicial Conduct punished Herbie by gifting him with a complimentary censure.
