The state of New Mexico provided  A. Blair Dunn with a law license in 1976 after he graduated from the University of New Mexico School of Law. Dunn also received a license to practice law from the state of South Dakota.

 

In one matter, Dunn represented several plaintiffs in case attacking the validity to New Mexico bail reform rules that discouraged the use of money bails.

 

Circuit Judge Mary Beck Briscoe dismissed Dunn’s lawsuit and granted sanctions because there was no reasonable basis to think the defendants’ immunity could be overcome and no reasonable basis to think the bail group and legislators had standing. The trial judge required Dunn to pay a $14,868 sanction.

 

Dunn the Dunce then appealed Judge Briscoe’s dismissal and $14,868 sanction to the 10th Circuit Court of Appeals. The appellate court upheld Judge Briscoe’s dismissal and $14,868 sanction. In its ruling the appellate court stated that the plaintiffs’ standing arguments “ignored controlling precedent,” and their immunity arguments “suffer from similar infirmities.”

 

In a lame effort at levity, Dunn has indicated that he may well appeal the Court of Appeals ruling to the United States Supreme Court. I can assure you that he will be denied certiorari and may well be subject to being sanctioned again.
