Attorney Douglas Marshall of Bozeman, MT; ethical ogre

 

The state of Montana presented Douglas W. Marshall with a law license in 1994 after he graduated from the University of Montana School of Law.

 

The Office of Disciplinary Counsel of Montana (ODC) found Doug guilty of engaging in the following misconduct.

  • Failed to provide client with written communication setting for the scope of the representation or the basis or rate of fees and expenses
  • Even though the client terminated the representation, Doug failed to formally withdraw from the client’s case
  • Failed to effect service of client’s complaint on the defendants within the 90-day requirement
  • Failed to appear at a hearing for Doug to show cause why his client’s case should not be dismissed
  • Failure to appear at show cause hearing led to dismissal of client’s case with prejudice (means client could never purse the matter again)
  • Attempted to collect unreasonable fee of $6,162.67
  • Unreasonable fee included $2,970 for text messages, $1,199 for hand-delivery of lawsuit in Butte, and $618.75 for responding to the client’s ethics complaint

As a direct consequence of his misconduct, the cheerleaders for Attorney Misfits sitting on the Montana Supreme Court punished Doug by gifting him with a complimentary admonishment.  

 

As we speak (ca. October 2020), Doug practices at 2000 Fairway Drive in Bozeman, Montana.
