Attorney David Salwowski of Indianapolis; ethical twerp

The state of Indiana provided Brian David Salwowski with a law license in 1984.

The Indiana Disciplinary Commission found David guilty of the following misconduct.
  1. Failed o provide client with written fee agreement
  2. Failed to provide client with written explanation of distribution of funds
  3. Failed to properly supervise non-lawyer staff
  4. Brought a legal action that as without merit
David represented a furniture store in its bankruptcy for an agreed fee of $1,500. Dave filed the bankruptcy action without listing his firm as a “pre-petition” creditor, which he was lawfully required to do since the furniture store owed his firm for prior legal services provided to it.

As a result of the client’s pre-petition debt to the law firm was protected from further collection once final discharge in bankruptcy was granted, which it subsequently was. Even though client’s pre-petition legal bills were discharged in bankruptcy, David filed suit against his client for the pre-petition legal fees. The sham lawsuit was subsequently dismissed.

the outstanding bills were transferred to the client’s bankruptcy billing statement by the firm’s named partner.

As a consequence of her misconduct, the cheerleaders for Attorney Misfits sitting on the Indiana Supreme Court punished David by gifting him with a complimentary reprimand.

As we speak (ca. October 2012) David practices at 8118 East Washington Street in Indianapolis, Indiana.
