In one matter, Jerrell Brown hired David to represent him on a social security disability claim. Over the next three (3) years Brown and his wife repeatedly called Dave’s office to check on the status of his claim. Although they spoke to Dave’s staff on occasions, the hardly ever spoke to Dave.

An initial hearing on Brown’s disability claim was subsequently scheduled. Dave only met with Brown briefly before the hearing to discuss his testimony, and to advise him what to expect at the hearing. The hearing was later rescheduled for the following day due to a conflict involving Dave and another matter.
Due to Dave’s gross negligence, he and Brown didn’t appear for the hearing, which led the Administrative Law Judge to deny Brown’s disability claim.

When Dave failed to shop up at the hearing, Mr. Brown called his office to find out why wasn’t at the hearing. Brown specifically instructed the Browns to not go forward with the hearing before the Administrative Judge. The Browns then left the hearing site, having no knowledge that the Judge had already denied the disability claim the day before.

After receipt of the disability denial notice, the Browns fired Dave and filed a complaint with the Florida Bar. At the disciplinary hearing, several Administrative Law Judges testified that Dave was grossly negligent in representing numerous clients. According to two witnesses, Dave had an addiction to drugs.

In another matter, Dave was arrested and charged with doctor shopping, fraud and concealing information to obtain prescript drugs. Subsequently, Dave entered into a Deferred Prosecution Agreement, agreeing, among other things. To submit to random urinalysis testing and was placed on probation.
