Attorney David Bath of Loveland, CO; slacker, serial offender

 

The state of Colorado provided David Eugene Bath with a law license in 1974 after he graduated from the University of Colorado Law School.

 

The Colorado State Bar found Dave guilty of the following misconduct.

 

Dave’s 1st bite at the Attorney Misfit Apple Tree

  • Repeatedly failed to advise clients that consulting with independent counsel would be advisable prior to entering into business dealings with them’
  • Failed to obtain required written consent from clients re: business dealings
  • Failed to advise clients of conflict that might be inherent in his representation of all defendants involved in a state court action

As a direct consequence of his misconduct, the enablers for Attorney Misfits sitting on the Colorado Supreme Court punished Dave by gifting him with a complimentary 75-day suspension of his law license.

 

Dave’s 2nd bite at the Attorney Misfit Apple Tree

  • Recklessly failed to segregate client funds
  • Failed to ensure systems in place to properly account for client funds
  • Commingled client funds with personal funds

As a direct consequence of his misconduct, the enablers for Attorney Misfits sitting on the Colorado Supreme Court punished Dave by gifting him with a complimentary stayed 30-day suspension of his law license.

 

In truth, the comedians sitting on the Colorado Supreme Court didn’t mete out any meaningful punishment to Dave.

 

Dave’s 3rd bite at the Attorney Misfit Apple Tree

  • Failed to act with due diligence (slacker)
  • Failed to keep client informed of status of legal matter
  • Knowingly disobeyed rules of a tribunal
  • Engaged in conduct involving fraud, deceit, dishonesty or misrepresentation
  • Engaged in conduct prejudicial to the administration of justice
  • Failed to comply with six (6) court orders
  • Never filed response to opposing counsel’s motion re: discovery
  • Court imposed $8,500 in sanctions for discovery order violations
  • Never advised client of $8,500 court sanction

As a direct consequence of his misconduct, the enablers for Attorney Misfits sitting on the Colorado Supreme Court punished Dave by gifting him with a complimentary 4-month suspension of his law license.

 

As we speak (ca. November 2015) Dave practices with The Law Firm of David Bath PLLC at 4002 West Eisenhower in Loveland, Colorado.
