Attorney James Bennett of El Cerrito, CA; idiotic slacker

 

The state of California presented James Todd Bennett with a law license in 1985 after he graduated from the University of Pacific McGeorge School of Law.  

 

The State Bar Court found Jimmy guilty of engaging in the following misconduct.

  • Misconduct involved multiple offenses
  • Failed to act with due diligence (slacker)
  • Willfully failed to perform legal services with competence (idiot)  
  • Engaged in a pattern of misconduct
  • Misconduct significantly harmed a client, the public or the administration of justice
  • Failed to timely pursue 45 petitions before the Ninth Circuit, resulting in their dismissal for failure to prosecute (failure to file
  • opening brief
  • Failed to respond to court order to show cause why case should not be dismissed for lack of jurisdiction and/or failed to respond to court order (Up yours, said Jimmy!)
  • 35 client cases were dismissed because Jimmy did not properly withdraw the case or notify the court of
  • jurisdictional issues once they arose, but instead relied on the court to address the jurisdiction
  • Failed to move for voluntary dismissal of approximately 21 cases that were no longer viable

As a direct consequence of his misconduct, the enablers for Attorney Misfits sitting on the State Bar Court punished Gerry by gifting him with a complimentary 60-day suspension of his law license.
