Judge Brenda Branch of Halifax, NC; ethical goblin 

 

The state of North Carolina presented Brenda G. Branch with a law license in 2001 after she graduated from North Carolina Central University Law School.

 

The North Carolina Judicial Standards Commission found Judge Branch guilty of the following misconduct.

 

In one matter involving a domestic divorce case, the defendant was overseas in South Korea in the military, and he used the Servicemember’s Civil Relief Act of 2003 to request more time before being able to come back to the United States.

 

Even though the service member was out-of-country and unable to appear in court, Judge Branch had the chutzpah to conduct two hearings in the divorce matter. She then entered default judgments against him despite the fact he wasn’t present and not represented by counsel.

 

In truth, Judge Brach cheerfully trampled all over this GI’s constitutional due process rights. Apparently, she is of the opinion that “due process” is the means by which the grass becomes moist in the morning.

 

As a consequence of her misconduct, the cheerleaders for Judicial Misfits sitting on the North Carolina Supreme Court punished Brenda by gifting her with a complimentary reprimand.

 

As we speak (ca. April 2015), Brenda remains sitting as a Halifax County District Court judge in Halifax, North Carolina.
