It should be noted that Bobby is not a licensed attorney nor did he attend law school.

The West Virginia Judicial Investigation Commission found Bobby guilty of the following misconduct.

• Used judicial position to advance his home health agency in a newspaper advertisement
• Failed to comply with the law
• Conduct failed to promote public confidence in the judiciary
• Allowed family, social, political, financial, or other interests or relationships to influence his conduct or judgment
• Participated in activities that would appear to a reasonable person to undermine his independence, integrity, or impartiality

As a direct consequence of his misconduct, the cheerleaders for Judicial Misfits sitting on the Judicial Investigation Committee punished Bobby by gifting him with a complimentary admonition.

As we speak (ca. July 2018), Bobby continues to sit as a Randolph County Magistrate in Elkins, West Virginia.
