The state of Arizona presented Diana McCulloch with a law license in 1984 after he graduated from California Western University Law School.
The Arizona State Bar found Diana guilty of the following misconduct.
Dianna’s 1st bite at the Attorney Misfit Apple Tree - 2002
- Wrote checks on insufficient funds account (rubber)
- Violated her duties and obligations as a lawyer
- Misconduct involved multiple offenses
- Failed to cooperate with ethics investigators (Up yours, said Diana!)
- Commingled client funds with personal funds
- Failed to safeguard client property
- Failed to maintain complete and accurate records of the use and maintenance of her trust account
- Failed to maintain required client ledgers
- Engaged in a pattern of misconduct
- Refused to acknowledge wrongful nature of her conduct
As a consequence of her misconduct, the Cheerleaders for Attorney Misfits sitting on the Arizona Supreme Court punished Diana by gifting her with a complimentary 6-month suspension of her law license.
Dianna’s 2nd bite at the Attorney Misfit Apple Tree - 2011
- Fee agreement contained conglomeration of contradictory terms
- Failed to timely provide client with client file after being fired
As a consequence of her misconduct, the Cheerleaders for Attorney Misfits sitting on the Arizona Supreme Court punished Diana by gifting her with a complimentary censure.
Dianna’s 3rd bite at the Attorney Misfit Apple Tree - 2013
- Failed to use proper procedure to unseal custody evaluation
- Improper conduct caused delays in proper representation of client’s interests
- Unnecessarily used court resources
- Inconvenienced a nonparty that could not comply with subpoena based on court orders and confidential nature of documents requested by Diana
- Conduct led to trial court order Diana to pay attorney fees
- Failed to comply with court order
As a consequence of her misconduct, the Cheerleaders for Attorney Misfits sitting on the Arizona Supreme Court punished Diana by gifting her with a complimentary reprimand.
Dianna’s 4th bite at the Attorney Misfit Apple Tree - 2014
- Engaged in an improper conflict of interest
- Knowingly filed pleadings on behalf of potential adoptive parents who were not parties to the legal action
- Knowingly failed to pay court imposed sanction for two years
- Engaged in a pattern of misconduct
- Refused to acknowledge wrongful nature of conduct
As a consequence of her misconduct, the Cheerleaders for Attorney Misfits sitting on the Arizona Supreme Court punished Diana by gifting her with a complimentary 30-day suspension of her law license.
As we speak (ca. February 2015) Diana practices with the McCulloch Law Offices at 4635 South Lakeshore Drive in Tempe, Arizona.
