Attorney Thomas Gagne of Greenville, SC; ethical gremlin

 

The state of South Carolina presented John M. Curtin with a law license in 1995 after he graduated from the State University of New York (SUNY) at Buffalo Law School.

 

Disciplinary Counsel of the South Carolina Supreme Court found Tommy guilty of the following misconduct.

 

  • Allowed staff member to endorse client’s name on settlement check
  • Entered into agreement with fellow attorney that eliminated a clients’ right to choose who would serve as counsel
  • Sent selection letters for representation to shared clients without ever informing fellow attorney that he had so acted
  • Instructed his paralegal to attend deposition on his behalf without advising opposing counsel he wasn’t an attorney
  • Failed to abide by client’s decision re: acceptance of settlement offer
  • Failed to properly supervise office staff
  • Assisted a non-lawyer in the unauthorized practice of law

As a consequence of his misconduct, the enablers for Attorney Misfits sitting on the South Carolina Supreme Court punished Tommy by gifting him with a complimentary 60-day suspension of his law license. 

 

As we speak (ca. December 2014), Tommy practices with the Attorney Offices of Thomas M. Gagne PA at 101 Chapman Street in Greenville, South Carolina.
