Attorney James Hairston Jr. of Raleigh; serial offender

The state of North Carolina presented James E. Hairston Jr. with a law license in 1993 after he graduated from North Carolina Central University Law School.

The Grievance Committee of the North Carolina State Bar charged Jimmy with the following misconduct.

In addition to the below three cases of misconduct, Jimmy received a complimentary Admonition in May 2001 and a complimentary warning letter in November 2004 for engaging in a variety of misconduct

Jimmy’s 3^rd bite at the Attorney Misfit Apple Tree – 2004

• Failed to file individual state income tax returns for four separate years
• Failed to pay individual state income tax returns for four separate years
• Willful failure to pay state income taxes constitutes criminal act
• Misconduct involved multiple violations

As a consequence of his misconduct the cheerleaders for Attorney Misfits sitting on the Grievance Committee of the North Carolina State Bar punished Bobby by gifting him with a complimentary stayed 2-year suspension of his law license.

In truth, the comedians sitting on the Grievance Committee didn’t mete out any meaningful punishment to Jimmy.

Jimmy’s 4^th bite at the Attorney Misfit Apple Tree – 2004

• Failed to properly supervise associate
• Negligently failed to file motion
• Filed motion w/o supporting memorandum
• Failed to advise client of filing of motion to reconsider
• Failed to tell client that motion to reconsider was denied
• Failed to communicate with client for over one year

As a consequence of his misconduct the cheerleaders for Attorney Misfits sitting on the Grievance Committee of the North Carolina State Bar punished Bobby by gifting him with a complimentary reprimand.

Jimmy’s 5^th bite at the Attorney Misfit Apple Tree - 2012

• Maintained professional relationship with disbarred attorney Craig McGannon
• Accepted numerous referrals from McGannon
• Issued business cards to McGannon under law firm’s name
• Provided McGannon with firm-specific email address w/o disclosing his status as disbarred attorney
• Assisted McGannon in the illegal practice of law

As a consequence of his misconduct the cheerleaders for Attorney Misfits sitting on the Grievance Committee of the North Carolina State Bar punished Jimmy by gifting him with a complimentary reprimand. 

As we speak (ca. November 2014) Jimmy practices with Hairston Lane Brannon PA in Raleigh, North Carolina.
