District Attorney Donald Gallegos of Taos, NM; ethical misfit

 

The Disciplinary Board of the New Mexico Supreme Court charged Donnie with the following misconduct.

 

  • Engaged in conduct prejudicial to the administration of justice
  • Issued nearly 50 subpoenas that he knew did not comply with New Mexico law
  • Failed to properly supervise subordinate attorney
  • Served illegal subpoenas that were not authorized by a court
  • Judge Paternoster ruled it was “objectively unreasonable for the prosecutor [Donnie] to believe that his conduct was lawful”
  • Failed to provide competent representation to client (Dufus)
  • Unlawfully obstructed another party’s access to evidence
  • Failed to obey the rules of a tribunal
  • Used methods to obtain evidence that violated legal rights of third person

All that remains now is to see what punishment is meted out to Donnie by the New Mexico Supreme Court.

 

As we speak (ca. October 2014), Donnie continues to serve as the District Attorney for several counties in the Taos, New Mexico area.
