Attorney Raymond Malouf of Logan, UT; ethical misfit

 

The state of Utah presented Raymond N. Malouf with a law license in 1973 after he graduated from the University of Utah Law School.

 

The Ethics and Discipline Committee of the Utah Supreme Court found Ray guilty of the following misconduct.

 

In one matter, Ray was hired to pursue a personal injury action on his client’s behalf. Subsequently, Ray received an offer from the attorney for the opposing party’s insurance company to settle the matter for the policy limits.

 

Ray advised his client to accept the settlement but the client rejected the offer. In a later meeting, the client told Ray that he would get back with him on whether to or not to settle the matter.

 

Before the client could respond, Ray accepted the settlement and deposited the funds into his trust account. Of course Ray’s acceptance of the settlement was without any approval or authority from his client, which he well knew he was required.

 

As a consequence of his misconduct, the enablers for Attorney Misfits sitting on the Utah Supreme Court punished Ray by gifting him with a complimentary reprimand.

 

As we speak (ca. September 2014) Ray practices with the Malouf Law Offices LC at 150 East 200 North Street in Logan, Utah.
