Judge Henry Barela of Los Angeles:greedy scofflaw, ethical gnome

 

Judge Henry Barela has been sitting on the Superior Court in Los Angeles County for many, many years.
 
In 1997, the state of California assumed the funding of all state trial court operations, including payment of salaries and benefits (pension, health/life insurance) for all trial court judges.
 
Prior to 1997, all fifty-eight (58) counties in California paid for all trial court operations and judge salaries, etc. via the use of county taxpayer funds.
 
When the taxpayers of California began to pay the salary and benefits for Judge Henry Barela, he continued to collect the same (duplicate) benefits from the taxpayers of Los Angeles County. Put simply, Judge Henry Barela was engaged in “double dipping” by collecting the same benefits from the state and LA County taxpayers.
 
Obviously, this type of conduct is not only abhorrent but clearly indicates that Judge Barela is not only greedy but an ethical leper-con. From 1998 through at least 2008, Judge Barela collected about $38,000 (ca. 2004) in duplicate benefits from LA County taxpayers for a total of at least $418,000 that he clearly was not lawfully entitled too.
 
Examples of the illegal compensation Judge Barela received from LA County are:
  • $2,277 per month ($27,324 a year) as a cash allowance
  • $350 per month ($4,200 a year) as a development allowance (not to be spent on ethics lessons per court order!)
LA County also paid an additional retirement benefit in an amount unknown on Judge Barela's behalf which was above and beyond the reitrement benefit he already received from the State of California.
 
As a result of this illegal double-dip, Judge Barela’s annual income was $182,000 in 2004 compared to the $143,838 received by judges in the other fifty-seven counties in California.
 
Subsequently, Judicial Watch filed a lawsuit claiming this “double-dipping” to be unconstitutional. In 2008, the California Court of Appeals agreed and in Jan. 2009, the California Supreme Court refused to grant an appeal to Judge Henry Barela and his fellow thieves sitting on the LA County Superior Court.
 
Of course Judge Barela never reimbursed the overtaxed citizens of LA County for this illegal and unconstitutional “double-dipping.” Put simply, Judge Barela found it both acceptable and ethical to retain over $400,000 that the Court of Appeals ruled he was not constitutionally entitled too.
 
Conclusion
Isn’t it comforting to know that an ethical gnome such as Judge Henry Barela continues to sit in judgment of the citizens of Los Angeles County that have to appear before him?
 
How in the hell can anyone give any credence to any rulings emanating from a jurist who has proven beyond all doubt that he is nothing more than a certified thief?
