Is Judge Daniel Gaul of Cleveland guilty of misconduct?

 
Judge Daniel Gaul has sat on the Cuyahoga County Common Pleas court in Cleveland for several years.
 
In 2007, Judge Daniel Gaul presided over a criminal case wherein the defendant was charged with assaulting his girlfriend and the 83-year-old woman she was caring for. When the 83-year-old woman failed to appear at the criminal trial, he surmised that the defendant was guilty of intimidation (threatening her to not testify.)
 
Judge Daniel Gaul then stated in open court to the defendant, “Justice may be blind. But it has a heart, and it has a soul, and it has common sense [Give me a break Paulie!]. And I would bet my life on the fact that you, sir have been involved in obstruction of justice.”
 
Over the objections of the defendant’s attorney, Judge Daniel Gaul went on to say, “And I also would bet my life, if I had to right now, that you have been involved in a technical kidnap through Mozelle Taylor.” (Cleveland Plain Dealer, Leila Atassi – 9/21/09)
 
Subsequently and ethics complaint was filed against Judge Daniel Gaul, which was aggressively pursued by Disciplinary Counsel, Jonathan Coughlan.
 
Jonathan Coughlan’s pursuit of Judge Daniel Gaul led to a recommendation in Jan. 2010 that Judge Gaul be suspended for a year for threatening to jail a defendant he thought was intimidating an elderly witness. However, it was recommended that the entire suspension by stayed, so Judge Gaul’s record would have a blemish but he would be allowed to stay on the job. The decision is now pending before the justices of the Ohio Supreme Court. (Cleveland Plain Dealer, Reginald Fields, 1/13/10)
 
I’ll let you decide if you believe that Judge Daniel Gaul deserved the punishment recommended by Jonathan Coughlan.
