Shortly after Manuel filed the sham lawsuit,
A spokesman for the family of one of the alleged crash victims named in the petitions confirmed that Ribbeck Law was not authorized by the family to file the petition in the first place (Chicago Tribune)
In dismissing the two filings, Judge Flanagan said the law allows for such filings only when the identity of potential defendants isn’t known. She went on to say the proper procedure would be to sue the defendants first and obtain evidence during the normal discovery process of an ongoing lawsuit.
Judge Flanagan stated that Ribbeck Law had filed virtually identical petitions in 2013 after airplane crashes in San Francisco and Laos, and the had dismissed both for the same reason she dismissed the Malaysian lawsuit.
Judge Flanagan went on to say in her dismissal ruling:
“Despite these orders [sham lawsuits v. crashes in San Francisco and Laos], the same law firm has proceeded, yet again, with the filing of the (Malaysia crash) petition, knowing full well there is no basis to do so.”
It should be noted that Manuel was found in contempt of court in mid-March 2014 for failing to comply with a judge’s order in a 2012 paternity suit filed in Cook County Circuit Court
Manuel is a total embarrassment to all hard working and well-intentioned ambulance chasers.
As to the contempt finding, it shouldn’t be long before the Disciplinary Commission files charges against Manuel. Hopefully, Manuel will have his license suspended for several years.
