Misconduct of retired Judge Dana Deshler of Columbus, Ohio

Below is an ethics complaint filed against Judge Dana Deshler for unlawfully billing the state for wages he was clearly not entitled too.

As you can see, a copy of this letter was forwarded to Chief Justice Thomas Moyer to provide him with irrefutable evidence that Judge Dana Deshler did not under any circumstances merit reappointment by Moyer.

Even though Chief Justice Thomas Moyer received a copy of this letter in early March 2007, he deemed that Judge Dana Deshler merited further appointments. In fact, Chief Justice Moyer continued to appoint Judge Dana Deshler through December 2007.

Re:    Misconduct of retired Judge Dana Deshler of Columbus

Dear Mr. Marshall:

Deshler is a retired judge from the 10th District Court of Appeals in Columbus.   From June 2003 to Dec. 2004, Deshler billed the State 31 times to make roundtrips from his home at 1008 Willow Bluff Drive, Columbus, OH 43235 to the 10th District Court of Appeals, and billed 1.0 hours per roundtrip ($59) and collected $1,840.30 from the State. As a resident of Franklin County, Deshler knew that he was prohibited him from receiving wages for the mere act of traveling to work

RC 141.07 prohibits a visiting judge from receiving travel expenses unless he/she is working in a County other than his/her residence. Patently, wages for travel within one’s resident County would also be prohibited.

Not satisfied with collecting improper compensation, Deshler decided to engage in multiple thefts-in-office by falsely claiming that each roundtrip took 1.0 hour. Deshler lives a mere 9.9 miles from the Court and according to www.mapquest.com it takes 15 minutes to get there, which means a roundtrip is 30 minutes and not the 60 minutes that Deshler falsely claims.

The table below contains details the multiple thefts-in-office perpetrated by Deshler.

As with Judge Patton, I will be forwarding a copy of this complaint to CJ Moyer in hopes that he will immediately discharge Deshler to prevent further thefts of public funds. Please provide me with a copy of Deshler’s reply upon receipt of it.
