Chief Justice Thomas Moyer admits Judge Richard McQuade is an incompetent idiot

In the April 27, 1998 Edition of Ohio Lawyers Weekly newspaper, Chief Justice Thomas Moyer answered the question below as follows:

Q.                "What is your response to the recent concern over the use of visiting judges?"

A.                 "I think the visiting judge system generally works well. The Chief Justice cannot monitor the use of every visiting judge that sits. It's not practical and I wouldn't pretend to do that. One of the things I can do is if … a judge is acting in a way that the judge should no longer be sitting; it is very easy and very quick for me to simply terminate the visiting judge assignment. That's one advantage of a visiting judge and I've done that a few times. I have actually terminated an assignment based upon some knowledge that came to me about the way in which a judge was acting.

The system is not perfect, I don't think it can ever be perfect when you have this sort of tension between judges, courts wanting more visiting judges and [the Supreme Court] saying you can only have a certain number. So we come to sort of a compromise."

Clearly, in his answers to Lawyers Weekly, Chief Justice Thomas Moyer was opining that Judge Richard McQuade was one of those competent visiting judges that he claims serves a beneficial need to the voters and taxpayers of Ohio. The following undisputed facts, all of which were gleaned from public records provided by the Ohio Supreme Court should render Chief Justice Thomas Moyer's answers to be comical at best.

1.                  On October 4, 1993, Judge Neil M. Laughlin sent a letter with attachments to Moyer explaining his reasons for withdrawing from any further participation in the case of Mills v Briggs that was pending in Jefferson County. (See Ex. X)

2.                  Judge Laughlin's letter exposes what he perceived to be egregious misconduct engaged in by Judge Corabi and attorneys Stern and Bruzzese in taking affirmative action to protect Dr. Briggs, who was apparently a powerful political figure in the area.

3.                  In handwritten notes taken by someone at the Supreme Court during a conversation with Judge Laughlin and then submitted to Moyer, the following appears:

"He (Judge Laughlin) strongly feels that attorneys Stern, Bruzzese and Judge Corabi "wiped out case", "white washed case" so no criminal charges would be brought against Dr. Mills (powerful, political).  (I have more detail)"

"He (Judge Laughlin) said any Judge who looks at case carefully will see this. If noted, next Judge will be as prejudiced as he is. ("A Judge would have to close his eyes not to see this").

            How to handle?

1.                  "Assignment of Judge.  (Who can handle since competent Judge will find some problems)."
2.                  "His (Judge Laughlin's) last sentence on entry: "take any action that is justified".

Now, here comes Moyer's hand written reply:

"What about Judge [Richard] McQuade?"

On November 16, 1993, Moyer assigned Judge Richard McQuade, a Judge that he readily acknowledged was incompetent

Chief Justice Thomas Moyer’s comment “What about Judge McQuade” is not only an admission that Judge McQuade is incompetent but further proves that he was a member of a “hit team” of dishonest retired judges assembled by Chief Justice Thomas Moyer to reward his friends/associates/contributors and/or to punish his real and/or perceived enemies (whistleblowers, etc.).
