Attorney Sara Bergman of Cedarburg, WI; lying loser

The state of Wisconsin presented Sara Bergman with a law license in 2002 after she graduated from Marquette University Law School.

The Office of Lawyer Regulation (OLR) found Sara guilty of the following misconduct

In one matter, Sara was employed as claims counsel for a title insurance company that insured two adjacent lots when they were purchased by a husband and wife. The deed restriction was not listed as an exception from coverage in the title insurance policies.

The parties to the lawsuit settled it by stipulating that any home build on the second lot by the husband and wife would comply with the deed restriction. Prior to agreeing to the stipulation, counsel for the husband and wife contacted Sara, who confirmed the title company's approval of the proposed stipulation. Sara also confirmed that the settlement would not affect the title company's coverage of a possible decrease in value of the second lot resulting from the couple's compliance with the deed restriction.

On three occasions, Sara made false statements to the couple’s attorney implying she had ordered an appraisal of the second lot, but she had not yet formally hired an appraiser.

Subsequently, the couple filed a lawsuit against the title company for breach of contract and bad faith in handling their claims. During the pendency of the lawsuit, Sara provided an affidavit wherein she knowingly made a false statement under oath.

Because Attorney Misfits in Wisconsin are held to a much lower standard of conduct then everyone else, Sarah was never criminally charged with perjury.

As a consequence of her misconduct, cheerleaders for Attorney Misfits sitting on the Wisconsin Supreme Court punished Sara by gifting her with a complimentary reprimand.

As we speak (ca. February 2014) Sara practices at 2041 Wildwood Drive in Cedarburg, Wisconsin.
