Attorney John Fitzgerald of Dayton, TN; repeat offender The state of Tennessee presented John Arnold Fitzgerald with a law license in 1973 after he graduated from Cumberland Law School.
The Tennessee Board of Professional Responsibility found John guilty of the following misconduct.
Johnny’s 1st bite at the Attorney Misfit Apple Tree
In one matter, Johnny attempted to have a stolen diamond necklace returned to the prosecuting attorney (DA) if she agreed to drop charges against his client who was criminally charges with receiving and concealing stolen property.
As a consequence of his misconduct, the Patron Saints for Attorney Misfits sitting on the Tennessee Supreme Court punished John by gifting him with a complimentary 1-year suspension of his law license.
Johnny’s 2nd bite at the Attorney Misfit Apple Tree
Johnny found it acceptable to engage in the unauthorized practice of law while his law license was suspended. The suspension was the misconduct mentioned above.
As a consequence of his misconduct, the apologists for Attorney Misfits sitting on the Tennessee Supreme Court punished John by gifting him with a complimentary 30-day suspension of his law license.
Johnny’s 3rd bite at the Attorney Misfit Apple Tree
In one case, Johnny prepared a civil lawsuit against a former client in a matter substantially related to a case in which he previously had represented that client.
Put simply, Johnny engaged in an egregious conflict of interest.
As a consequence of his misconduct, the enablers for Attorney Misfits sitting on the Tennessee Supreme Court punished John by gifting him with a complimentary censure.
