Attorney Allen Rogers of Fayetteville, NC; ethical leprechaun The state of North Carolina presented Allen W. Rogers with a law license in 1988 after he graduated from the University of North Carolina Law School.
The Grievance Committee of the North Carolina State Bar found Allen guilty of the following misconduct.
In one matter, Allen represented a client in a personal injury case. After he filed the lawsuit, Allen failed to serve the named defendant.
Allen made no effort to make contact with the named defendant until several months later, but the attempt was unsuccessful. The attempt failed because Allen didn’t provide the required information about the named defendant to the locator service he hired.
Several months later, the court notified Allen that the client’s case had been removed from the active calendar. Allen failed to inform his client that the case was placed on the inactive calendar. When the client discovered this fact, Allen falsely told the client the case was moving along in an appropriate manner.
As a result of Allen’s gross incompetence and negligence, his client’s claims were forever barred because the statute of limitations for serving the named defendant with the lawsuit had expired.
As a consequence of his misconduct the cheerleaders for Attorney Misfits sitting on the Grievance Committee of the North Carolina State Bar punished Allen by gifting him with a complimentary reprimand.
As we speak (ca. November 2013) Allen practices with The Rogers Law Firm, PLLC at 111 Person Street in Fayetteville, North Carolina.
