Judge Richard Schoenstedt of Joliet, IL; Judge Roy Bean Wannabee

 
FYI: Judge Roy Bean was an infamous Justice of the Peace and saloon owner in Texas who called himself the "The Law West of the Pecos." Roy was also affectionately referred to as the Hanging Judge.
 
The state of Illinois presented Richard Carl Schoenstedt with a law license in 1981 after he graduated from DePaul University Law School.
 
In one matter, Judge Schoenstedt presided over the case of People of Illinois vs. Denis Demsco. After the case concluded, Judge Schoenstedt improperly refused to sentence Demsco to TASC (Treatment Alternatives for Safe Communities) probation.
 
Judge Schoenstedt refused to sentence Demsco to TASC probation despite the fact that he specifically ruled on the record that Demsco was an ideal candidate for TASC. Put simply, Judge Schoenstedt said “Up Yours!” in regards to following the mandatory sentencing requirements he was duty bound to follow.
 
As a result of Judge Roy Bean’s abusive conduct, the Court of Appeals reversed his refusal to sentence Demsco to TASC probation and sent the case back to him to allow for such a sentence, which would be consistent with Illinois law.
 
Unfortunately, the taxpayers of Illinois were made to pay for Roy Bean’s abusive conduct.
 
As we speak (ca. January 2014), Judge Schoenstedt continues to sit as an Associate Circuit Court Judge in Joliet, Illinois.
