Attorney Henry Bauer of Albany; Il Duce Wannabee, moron, ethical gnome

 

Previously, Henry Bauer was a sitting judge on the Troy City Court in Rensselaer County in New York.
In 2004, the New York Judicial Commission caused Judge Henry Bauer to be removed from the bench due to the egregious misconduct he had engaged in for several years.
 
It would be appear that Judge Henry Bauer was a die-in-the-wool fan of Il Duce, (aka, Mussolini) due to the manner in which he consistently violated the constitutional due process rights of the unfortunate litigants that appeared before his so-called Court. Moreover, it is obvious that Judge Henry Bauer conducted court proceedings in accordance with the Australian Rules of Court.

In one case, Judge Henry Bauer set bail at $25,000 for a man arrested for riding his bike on the sidewalk, which he couldn’t afford to pay. The maximum fine for this offense was $100, without any possibility of jail time. 
 
Nevertheless, this fellow spent seven (7) days in jail because he could not afford to pay the illegally high bail. Il Duce (Judge Henry Bauer) then coerced a guilty plea from the defendant without affording him the right to counsel.
 
Miscellaneous misconduct
 
Judge Henry Bauer was also found guilty of setting excessive bails at least thirty-seven (37) times and not affording defendants the right to counsel (due process) at least twenty-one (21) times, coerced guilty pleas by setting excessive bail 8 times, imposed illegal sentences five times and twice found a defendant guilty without a plea or finding of guilt. Il Duce would have been proud of Hank, right?
 
In 26 instances, and in total disregard of the law, Judge Henry Bauer set bails ranging from $10,000 to $50,000 for defendants charged with petty crimes or violations. Most of the offenses rarely, if at all, carried jail sentences upon conviction, a fact well known to Judge Henry Bauer.
 
An unreliable source indicated that on several occasions he heard Judge Henry Bauer defend his illegal conduct by saying, “I’ don’t need no stinkin laws, I am the law.”
 
In October 2004, the New York Court of Appeals ordered that Judge Henry Bauer be removed from the bench.

Hank blamed most of his procedural infractions on the fact that many defendants came before him while his court was temporarily – and inadequately – set up in Troy City Hall. Damn construction projects!

So-called well-respected legal minds, including Judge Patrick McGrath and Supreme Court Judge Thomas Keegan, testified on Hank’s behalf. 
 
The Rensselaer County Republican Party endorsed Hank for a second 10-year term, even though they knew it was likely he would be removed from the bench. Isn’t that just special?
 
Hank’s subsequent status
 
Believe it or not, Hank was subsequently elected President of the Troy, New York City Council. What in the world were the voters thinking when they elected this idiot? 
 
Apparently, “feeding at the public trough” was the only employment available for Hank. Obviously, no respectable law firm would employ such a fool, would they?
 
Think maybe it’s the water in Troy that causes these magical transformations? Could it be that voters in Rensselaer County prefer to have corrupt politicians serving them as long as they’re Republicans?
Who said crooked judges can’t be rehabbed? It sure as hell wasn’t the good ol’ folks in Troy. Kinda
 
Attorney Henry Bauer’s current status
 
As could be expected, the powers-to-be in New York never took any action to revoke attorney Henry Bauer’s law license. Obviously, they were much more concerned with assuring that Henry Bauer would continue to have an opportunity earn a dishonest living as an attorney then they were in protecting the citizens of upstate New York.
 
As we speak (ca. Nov. 2009), is practicing law at 20 Corporate Woods Blvd. in Albany, New York.
