Attorney Thomas Frerichs of Waterloo, IA; serial offender

 

The state of Iowa presented Thomas P. Frerichs with a law license in 1991 after he graduated from the University of Iowa Law School.

 

The Iowa Supreme Court Attorney Disciplinary Board found Thomas Guilty of the following misconduct.

 

Tommy’s 1st bite at the Attorney Misfit Apple Tree 2003

  1. Entered into an illegal fee agreement
  2. Failed to place advance fee in trust account as required
  3. Misappropriated (stole) clients funds
  4. Failed to properly account for client funds
  5. Failed to deliver funds owed to client to the client
  6. Neglected a legal matter entrusted to him
  7. Failed to safeguard client property
  8. Engaged in conduct adversely reflecting on fitness to practice law
  9. Repeatedly failed to cooperate with ethics investigators (Up Yours, said Tommy!)

As a consequence of his misconduct, the Patron Saints for Attorney Misfits sitting on the Iowa Supreme Court Attorney Disciplinary Board punished Thomas by gifting him with a complimentary 4-month suspension of his law license.

 

Tommy’s 2nd bite at the Attorney Misfit Apple Tree – 2004

 

In one matter, Tommy represented a client in a criminal matter. Subsequently, Tommy filed a Notice of Appeal of his client’s conviction; however, he failed to pay the $50 docketing fee at the time he filed the notice.

 

Tommy was later notified by the court that his client‘s appeal would be dismissed if he didn’t pay the $50 fee. Despite several warnings from the court, Tommy failed to pay the $50 fee, which then led to the dismissal of his client’s appeal. 

 

As a consequence of his misconduct, the Patron Saints for Attorney Misfits sitting on the Iowa Supreme Court Attorney Disciplinary Board punished Thomas by gifting him with a complimentary reprimand.

While appealing the DUI, Third offense conviction of his client, Tommy failed to comply with appellate deadlines, resulting in two notices of default from the Clerk of the Iowa Supreme Court. As a result of Tommy’s gross incompetence, his client’s appeal was dismissed.

 

As a consequence of his misconduct, the apologists for Attorney Misfits sitting on the Iowa Supreme Court Attorney Disciplinary Board punished Thomas by gifting him with a complimentary reprimand.

 

Tommy’s 4th bite at the Attorney Misfit Apple Tree - 2006

  1. Engaged in conduct involving fraud, deceit, dishonest or misrepresentation
  2. Engaged in conduct prejudicial to the administration of justice
  3. Engaged in conduct adversely reflecting on fitness to practice law
  4. Neglected a client’s matter entrusted to him
  5. Knowingly made a false statement of fact or law

As a consequence of his misconduct, the apologists for Attorney Misfits sitting on the Iowa Supreme Court Attorney Disciplinary Board punished Tommy by gifting him with a complimentary 90-day suspension of his law license.

 

As we speak (cca. August 2013), Tommy practices with the Frerichs Law Office in Waterloo, Iowa.
