Attorney Bernard Watts of Louisville; ethical dwarf

The state of Kentucky presented Bernard Gene Watts with a law license in 1977 after he graduated from the University of Louisville Law School.

The Kentucky Bar Association (KBA) found Bernard guilty of the following misconduct.

In one matter, Bernard was hired by Joyce Kirk in regards to a potential sexual harassment suit against her former employer, the Carbon-Graphite Group. Joyce also discussed her possible need to file for bankruptcy during her first meeting with Bernard.

Shortly thereafter, Bernard submitted a copy of the lawsuit against Carbon-Graphite to Joyce for her signature. Two months later he filed a Chapter 7 Bankruptcy Petition on Joyce’s behalf. However, Bernard failed to list the potential sexual harassment claim on the bankruptcy petition, even though he knew it was required by law.

Also, before Bernard filed the bankruptcy petition he represented Joyce on her claim for Social Security disability benefits. Subsequently, Bernard received a letter entitled “Notice of Award” approving month disability benefits of $958 along with a lump sum that was immediately paid to Joyce of $7,360. Again, Bernard violated bankruptcy laws by failing to claim the disability benefits as an asset of the bankruptcy estate.

Fourteen days after the bankruptcy court granted Joyce’s petition, Bernard then filed the sexual harassment lawsuit. Shortly thereafter, counsel for Carbon-Graphite filed a motion to dismiss the lawsuit arguing that the bankruptcy estate and not Joyce was the proper party to bring the lawsuit.

As a consequence of his misconduct, the enablers for Attorney Misfits sitting on the Kentucky Supreme Court punished Bernard by gifting him with a complimentary reprimand

As we speak (ca. July 2013) Bernard practices at 2825 Milburn Avenue in Louisville, Kentucky.
